Terms and Conditions for hotspot.apARTments
Please read the following terms and conditions carefully. With your booking (per eMail or telephone), you agree to these conditions. These thence form the basis of our rental agreement and are legally binding.

Deposit / Booking:
If you are interested in an apartment that we offer, kindly send us a written booking request or give us a call. We then check the availability and inform you of the results immediately. If your selected choice is available for the desired time period, you may book by eMail or telephone right away.
Upon receiving your booking, we reserve the apartment for you and send you a booking confirmation, driving directions, and our bank details.
A deposit of 25% of the total rent is to be paid within seven calendar days. The balance (75%) is to be paid at least four weeks before your booked arrival date.
For short-notice bookings, when your arrival date is less than four weeks away, the entire payment must be paid within five calendar days. If the deposit and final payment is not punctually credited to our account, we reserve the right to relet the apartment. Please refer to our cancellation policy.

The tenant carries all incidental costs for international money transfers.

Arrival and Departure Times:
The apartments are available on your arrival date after 2 p.m. Rooms must be vacated on your day of departure by 11 a.m. With a timely agreement, you may individualize your arrival and departure times (fees may apply). There is a fee for late arrivals: on or after 9 p.m. a fee of € 25, and on or after 11 p.m. a fee of € 40 will be charged.

Rates:
The apartment rates vary and depend upon the:
1. desired apartment
2. number of actual occupancy
3. length of stay
4. season
All prices include value added tax (VAT).

The rent payable is quoted in the booking confirmation/invoice and contains: house rules for use of the apartment, towels, bed linen (changed weekly by arrangement and extra charge), electricity, water, gas and internet (where available).

Key Exchange:
The key will be handed over at the apartment upon your arrival by one of us or one of our agents. At that same time, we will also give you a short briefing.

Occupants:
When booking, we ask you to correctly specify the number of people (children are counted as full people) in your group. In the event of an over-occupancy, the landlord or his agent is entitled to charge an extra, appropriate fee.

Cancellation / Withdrawal:
The tenant may at any time withdraw from the contract. In this event, the following charges apply: up to 28 days before arrival date 0% of the total rent

from 27 days before arrival date 20% of the total rent

from 15 days before arrival date 40% of the total rent

from 10 days before arrival date 60% of the total rent

from 5 days before arrival date 80% of the total rent

from 3 days before arrival date 100% of the total rent

in each case, booked before arrival.

Amounts already paid will be accounted for. In each case, the date of receipt of the cancellation message will count. The tenant may also present a replacement tenant. There is no entitlement to a refund in the cases of non-arrival, late arrival or early departure. This is true even when, through no fault of the guest (for example through illness) the services are not used.

Cancellation by the landlord:
If the apartment cannot be made available for unexpected reasons (for example inhabitabilty due to severe defects, force majeure or burglary, etc.), the tenant will receive a full refund of the rent and can herewith make no further claims.

Correspondence: Out of mutual interest, declarations of cancellation, rebooking, and modification must be communicated in written (postal, eMail) form.

Liability for Damage Caused by Tenant: Any damage will be charged and paid locally. You are oblidged to report to the landlord of any damage through your fault during your rental period. Should, after departure, the cleaning service discover any vandalism, the last tenant is automatically liable for the payment of damages.

Disclaimer: The landlord is not liable for damages sustained to persons or property. The landlord is not liable for circumstances that are not directly related to the rented apartment and contractual services. These include the area surrounding the apartments, streets and local conditions, distances, and the events surrounding the object, such as any construction work on local buildings or road works.
We are not liable for any influences on the rental property caused by force majeure, standard national water and power outages and weather warnings. The tenant´s arrival and departure takes place under personal responsibility and liability. In the event of burglary, theft or fire, the landlord is not liable for the tenant´s personal property. We recommend travel or trip cancellation insurance.

Complaints: Any claims must be reported immediately to the company hotspot.apARTments orally or in writing. Unfortunately, we cannot accept complaints after departure.

Jurisdiction: The court of jurisdiction is Berlin (regardless of nationality and residence of the tenant). If one or more provisions of this contract are held to be invalid, such provision will not affect the validity of the remaining provisions. German law applies.

In case of legal doubt, the German text takes precedence.
